TERMS & CONDITIONS

 

When you book you guarantee that you have the authority to accept and accept on behalf of your party the terms of these booking conditions. All accommodation and travel arrangements sold by us are subject to these terms & conditions.

 

CONTRACT

A contract exists as soon as we despatch our confirmation detailing what you have booked. This contract is made on the terms of these booking conditions, which are governed by English Law. Your contract is with Madeira Magic Properties. The accommodation is let for holiday purposes within the meaning paragraph 9 of the First Schedule to the Housing Act 1988, and there is no right of occupancy beyond the stated and agreed period. 

 

BOOKING

A deposit of 25% of the full cost of the package is required if you book 60 days or more prior to arrival. If you book less than 60 days prior to arrival the full amount is payable immediately. We will despatch a confirmation on receipt of the deposit. Once confirmation is despatched your contract is made with Madeira Magic Properties and the deposit is non-refundable. Deposits may be claimable on your insurance.

 

OPTIONS

Upon receipt of your enquiry by email or telephone, a Villa can be provisionally booked. This will be held for a period of 24h only. An oral request or provision of an option does not give rise to contractual obligations to you or to Madeira Magic  Properties and may be cancelled by either party. We do not hold options on late availability bookings.

 

PAYMENT

Payment is due 60 days before your arrival date and if we do not receive the balance by the due date we reserve the right to cancel without refund. Key collection details despatched after the full rental balance is received by us. The rent stated in the contract covers all the normal running costs, such as water, electricity, gas, garden upkeep, bed linen and towels. The rent includes fees and taxes, but does not included travel, transfers, fire wood.

 

SECURITY BOND

In addition to the rental fee there will be a security bond of £100/120€. The security bond will be fully refundable after your departure from the property, providing there are no claims against it. In the event of any excess damage of any kind, missing inventory items or excessive cleaning costs by our agents, the named person on the booking form will be held responsible for all additional costs which exceed the security bond.

 

CANCELLATIONS

All cancellations must be confirmed in writing by the person who signed the booking form. The following cancellation charges are payable as a proportion of the cost from the date we receive the written confirmation. The number of days prior to arrival are to the day on which written notice is received by us.

 

More than 60 days: - 25%
30 - 60 days - 50%
Less than 30 days - 100%

 

In the very unlikely event that the accommodation becomes unavailable due to circumstances outside our control we will endeavour to provide you with alternative similar accommodation or refund your payments to us in full.

 

CHANGES

Should you wish to make any changes to your confirmed booking, you must notify us by email as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests. Where we can, an amendment fee may be payable together with any costs incurred by ourselves.

Occasionally, we have to make changes to and correct errors on our website descriptions and other details both before and after bookings have been confirmed and cancel confirmed bookings. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so. If we have to make a significant change to or cancel your booking, we will tell you as soon as possible. We will endeavour to offer you an alternative should a significant change or cancellation occur. We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation.

 

ACCOMODATION DESCRIPTIONS

All descriptions given either verbally or in writing are made in good faith based on the information believed to be correct at the time. However, changes can take place, which are out of our control. Our reservations staff will endeavour to notify you of any changes before your arrival date. Photographs of accommodation are non contractual. Please note that family rooms are not necessarily larger than the norm.

 

SPECIAL REQUIREMENTS

 If you have special requests or requirements, you are responsible for advising us at the time of booking, although we cannot guarantee that any requests will be met. Failure to meet special requests will not be a breach of contract. It is your responsibility to satisfy yourself that the property is completely suitable for your needs. Please note that if a particular requirement is not specified on the Website then it is not provided.

 

PERIOD OF RENTAL

Rentals start after 3pm unless otherwise notified, and terminate at 10am on the day of departure unless different times agreed in advance. Change over days are flexible.

 

CARE OF THE PROPERTY

All persons stated on the booking form are responsible for the care of the property and are expected to take good care of it including the locking of all doors, windows and shutters. At the end of the rental period, all utensils, furnishings, walls, floors and fittings must be left clean and tidy. It is the guest's responsibility to notify Madeira Magic Properties immediately of any sudden equipment failure so that reasonable action can be taken to rectify the situation.

 

LINEN & TOWELS

Linen & towels are changed weekend on the day of your arrival, linen & towels may be changed more frequently by prior arrangement for a small additional fee of £5/5€ per person per week. Cot bedding is not provided and should be brought by the guests. Towels provided are only provided for use within the Property and should not be taken to the Public Pool or to the Beach.

 

NUMBER OF PERSONS USING THE PROPERTY

The number of persons occupying the property must not exceed the advertised number. Madeira Magic reserve the right to refuse entry to the entire party if this condition is not observed.

 

LIABILITY

We are not responsible for your travel to and from this point or for any expenses incurred including travel, accommodation, subsistence and loss of earnings caused by delay in return to your departure point, howsoever caused.

We will not be liable for any loss, delay or costs connected with or arising out of adverse weather conditions, including blocked roads. If, as a result of a force majeure, you miss your return departure and extra accommodation is required, We will not be responsible for that cost. We strongly recommend you to take insurance which, subject to terms, will cover this.

Madeira Magic Properties will not be liable for closure & subsequent unavailability of public facilities such as swimming pools or beaches.

Where excursions or services are provided by a company outside Madeira Magic Properties, even where such excursions or services are sold through our representative or a supplier of Madeira Magic Properties, we will have no liability.

All clients undertake not to damage their accommodation and to abide by the local regulations (especially in relation to noise). Clients are liable for the cost of any damage and any loss and Madeira Magic Properties reserve the right to recover costs from the client if necessary before homeward travel. The party leader shall be liable in the first instance for any claim against the party.

Total Liability is limited to the cost of the Rental.

 

RIGHT OF ENTRY

Representatives of Madeira Magic Properties will be allowed the right of entry to the property at all reasonable times for the purpose of inspection or to carry out any necessary repairs of maintenance.

 

COMPLAINTS

Every effort has been made to ensure that you have an enjoyable holiday. In the unlikely event that you have any reason to complain or experience any problems with your stay whilst away please contact Madeira Magic Properties immediately if any problem arises so that it can be speedily resolved. We cannot subsequently consider any complaints or enter into any correspondence about them unless this procedure has been followed

 

SMOKING

All Madeira Magic Properties are non-smoking properties, smoking is restricted to outside spaces.

 

DATA PROTECTION AND PRIVACY

Information provided on Booking Forms will remain confidential and will not be disclosed to a third party or used for any other purpose.

 

PERSONAL ITEMS

Clients are reminded that they are responsible for their own personal documents, baggage and personal possessions.

FORCE MAJEURE

We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of "force majeure". In these Booking Conditions, "force majeure" means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

 

GENERAL

Start day and finish day of your stay are stated on your confirmation.

 

In these terms and conditions:
   a) “We” or “Us” shall mean Madeira Magic Properties
   b) “the Property” shall mean the Madeira Magic Properties, villas or apartments that has been booked
   a) “You" shall mean the person named on the booking form.

 

PRICES AND WEBSITE ACCURACY

Please note, the information and prices shown on our website may have changed by the time you come to book your stay. Whilst every effort is made to ensure the accuracy of the website and prices at the time of requesting the booking, regrettably errors do occasionally occur. You must therefore ensure you check all details of your stay (including the price) on your booking acceptance.
